NSTP PRINTWORKS® 2010: TERMS & CONDITIONS

1.    All employees of The New Straits Times Press (Malaysia) Berhad (“NSTP”) and its group of companies and their immediate family members (including spouses, children, parents, brothers and sisters) are NOT eligible to participate.

2.    Entry is open to any person or the authorised representative of any corporate entity purchasing and completing a special NSTP PRINTWORKS® 2010 package.  For the avoidance of doubt, the person signing the NSTP PRINTWORKS® 2010 advertisement space order shall be deemed to have been duly nominated by his company to do so and whilst he/she shall be treated as the entrant, the company remains liable for the action of the said person.

3.    Each NSTP PRINTWORKS® 2010 package purchased includes one free BRAND advertisement production, along with one free PRODUCT advertisement production plus 5 copy changes across the 12 months.  The free commercial production includes copy writing and artwork.  Any images or logos are to be supplied in appropriate format by the advertiser at his/her cost. Customers cannot use congratulatory, greeting or contest advertisements or supplements/special features ads as part of the PRINTWORKS® program.

4.    All advertisers must submit a schedule at time of booking.  In the event that a PRODUCT advertisement is not submitted or nominated for publication by the due date, or that the appropriate material is not supplied, NSTP will publish the BRAND advertisement at any time across the course of the schedule. A 25% loading will be imposed for every change in schedule.

5.    Any change to the PRINTWORKS® campaign format will incur an additional loading at NSTP discretion of up to 50% of the nominated ad price.

6.    NSTP does not guarantee any editorial coverage or write-up for advertisers under the PRINTWORKS® packages.

7.    Existing customers may take up NSTP PRINTWORKS® 2010 packages in specific publication based on one of the following criteria – new customer to that publication, small customer to that publication, lapsed customer of that publication or a 2009 PRINTWORKS® customer who has completed all outstanding placement and payments.

8.    Advertising Agencies and 3rd party agencies that do not complete packages due to scheduling or non-payment will not be allowed to participate in future PRINTWORKS® programme.

9.    Advertising agencies and 3rd party agencies are not allowed to use multiple clients on one package unless approved by the Director of Advertising Sales / Head of Sales.

10.   These packages are not available in conjunction with any other offers or discounts. One advertiser / one brand per package.

11.  In the event of non-availability in a certain week or section, the ad will be re-scheduled on the next available day.   NSTP reserves the right to move any advertisements scheduled in Harian Metro or Metro Ahad to another day within the nominated week without notice.

12.  Requests for ads on specific pages in the front half of the newspaper - a 100% loading will be levied and an additional 25% loading from Friday to Sunday on Special Interest Section in Harian Metro and Metro Ahad.

13.  Advertisement copy is required at least two working days prior to publication. For Special Interest Sections or preprints, we need at least five working days prior to publication.  If nominated material is not supplied in time, NSTP will run the advertiser’s PRINTWORKS® Brand ad.

14.   NSTP is not responsible for compensating the advertiser for any fines/ legal action imposed by the regulatory authorities on the advertiser as a consequence of running their advertisement.

15.   All advertisements are to be utilized by 31 August 2011.

16.   Notwithstanding any other conditions, entrants to the competition agree that NSTP standard business trading terms form part of these conditions of entry with the exception that any NSTP PRINTWORKS® packages purchased are non-cancellable for the term of the contract.  The said trading terms are available for viewing at http://adtimes.com.my. NSTP however reserves the right to reject or not to publish any advertisement without having to assign any reason whatsoever whereupon NSTP will refund all amounts paid less any amount utilised corresponding to such number of advertisement published as full and final settlement of the matter. 

17.   Entrants who cancel their advertising package without completing the full term are not eligible to be in the prize draw. A 100% surcharge will be imposed on every package which is not started or completed at the end of the program. If utilised only 80% or below at the end of the campaign, each package will be surcharged according to balance unutilised. 

18.   To be eligible to be included in the major prize draw, payment of accounts and utilisation of ads for all NSTP PRINTWORKS® 2010 packages must comply with the agreed terms as at the end of June 2011.  These terms may be varied from time to time at the sole discretion of NSTP.

19.   Direct advertisers can elect to pay monthly in advance. Monthly amount is total campaign cost divided by 12 with two months payment being payable by August 20, 2010. Thereafter, one month payment on the 20th of the month (or closest business day) for the advertisements appearing the following month.  Final payment is June 20, 2011.  Advertisers paying by instalment must complete a payment plan.

20.   Entry into the draw will be given for each package deemed eligible under Clause 17 & 18 above.  Each entrant or their nominee will receive token (s) for each package to be placed in the entry barrel at the place of the draw. All entrants must complete the entry ticket.  One entry for each ‘mini’ package, two entries for each ‘quarter’ package, four entries for each ‘half’ package and eight entries for each ‘full’ package purchased.

21.   The first token drawn from the barrel wins the prize. All decisions of NSTP are final.

22.   Entrants or their nominees must be present at the draw to claim their prize. Otherwise their win will not be recognized.  The winner must have paid in full for all 2010 NSTP PRINTWORKS® packages prior to taking delivery of the prize.

23.   The first entry drawn will win one (1) Volkswagen EOS valued at RM248,000 (or similar model motor vehicle of equivalent value) (hereinafter called the “Vehicle”).  The Vehicle includes standard fittings, colour selections is subject to availability in view of the limited number of the Volkswagen Eos that are imported into the country (excluding metallic paint).

24.   The Vehicle does not include any registration, on road costs, tax, insurance and delivery – these are the responsibility of the winner.

25.   The Vehicle will be delivered immediately subject to stock availability and the winner acknowledges a firm order being placed with the dealer constitutes the winning of the Vehicle. NSTP is not responsible for any damage or alterations to the Vehicle once it is won.

26.   The Vehicle is not redeemable for cash or kind and must be taken as offered.

27.   The Vehicle will be awarded to the Company or the approved/appointed representative of the Company.

28.   NSTP shall reserve the right at its absolute discretion to substitute any of the prizes with that of similar value but not necessarily type or category at any time without prior notice.

29.   Promotion commences June 30, 2010 and closes on September 3, 2010 or at NSTP’s discretion.

30.   The draw will take place in July 2011 or such date as may be determined by NSTP at its absolute discretion at a place to be advised.

31.   All decisions concerning any issue or dispute connected in any way with the PRINTWORKS® trade promotion made by NSTP shall be final.  No correspondence or appeal will be entertained.

32.   NSTP, its sponsors or associated companies shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to incidental, indirect, consequential, special or punitive loss, damage or expenses and these shall include but not be limited to business interruptions, lost business, lost profits or lost savings) or for personal injury which is suffered or sustained in connection with the prize.

33.   NSTP shall reserve the right to use the names and/or photographs of the entrants as material for the purposes of advertising and publicity or such other purpose as NSTP shall deem fit whereupon the entrants shall not be entitled to claim ownership or other forms of compensation on the materials. Entrants may also be required to give comments for press releases, photographs, video, media interviews, and at any announcement event (s).

34.   Participation implies acceptance of all terms and conditions. Further these terms and conditions may be varied from time to time by NSTP at its sole discretion and all advertisers purchasing packages through NSTP PRINTWORKS® expressly consent to this term.
